Terms of Service

1. Introduction & Acceptance

By accessing or using mylifehistory.xyz or app.mylifehistory.xyz (collectively, "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

My Life History is a product of Gary Pope. These terms govern your use of the Service and form a binding legal agreement between you and My Life History. These terms may be updated from time to time. We will notify you of material changes by email or by posting a prominent notice on the site.

2. Service Description

My Life History is an AI-guided memoir application that helps users record, organize, and transform personal memories into written memoir chapters. The Service provides:

  • AI-guided voice and text interview sessions to capture your memories
  • AI-powered memoir chapter generation from your interview sessions
  • A digital book view, editing tools, and PDF export for your finished memoir
  • Secure cloud storage for your memoir content, session transcripts, and photos

The Service is currently in open beta and is provided at no charge during the beta period. Features and functionality may change during beta as we continue to develop the product.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload, share, or create content that is illegal, abusive, defamatory, harassing, or that infringes on the rights of any third party
  • Use the Service to harass, threaten, or harm any individual or group
  • Attempt to reverse engineer, decompile, or extract the underlying AI models, source code, or proprietary algorithms used by the Service
  • Use the Service in any way that violates applicable local, national, or international laws or regulations
  • Attempt to gain unauthorized access to any portion of the Service or its related systems
  • Use the Service to generate, store, or distribute harmful, illegal, or offensive content

We reserve the right to terminate or suspend accounts that violate these terms, with or without notice.

4. Your Content

You retain full ownership of all memoir content you create using the Service — including your memories, stories, voice recordings, session transcripts, and photos you upload. My Life History makes no claim to ownership of your personal content.

By using the Service, you grant My Life History a limited, non-exclusive, non-transferable license to process, store, and display your content solely for the purpose of providing the memoir service to you. We will not use your content for any other purpose — including advertising, research, AI model training, or any commercial use beyond delivering the Service.

You may export or delete your content at any time. Your memoir can be exported as a PDF at any time from the app. To request deletion of all your data, see our Privacy Policy.

5. Beta Program

The Service is currently in open beta. During the beta period:

  • Access is provided free of charge — no payment information is required
  • Features may be added, modified, or removed without prior notice as we continue development
  • The Service is provided "as-is" without warranty of any kind
  • We may occasionally experience downtime for maintenance, updates, or unexpected issues
  • Some features may be experimental and may not perform perfectly

We sincerely appreciate your patience and feedback as we build. Beta users who share feedback help shape the product for everyone.

6. Subscription & Payment

When My Life History launches publicly, access will require a paid subscription. Specific pricing and subscription terms will be communicated clearly before the beta ends — you will not be charged without notice and your explicit consent.

Beta users who remain active will receive early-access pricing as a thank-you for participating in the beta program and helping shape the product. Your memoir content will not be deleted when the paid subscription launches — your account and content carry forward.

7. Intellectual Property

The My Life History software, application design, user interface, and any AI-powered improvements developed by My Life History are owned by Gary Pope / My Life History and are protected by applicable intellectual property laws.

Your memoir content — the memories you share, the stories written with AI assistance from your words, and the photos you upload — is owned entirely by you. My Life History claims no intellectual property rights in your personal content.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY LIFE HISTORY AND GARY POPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS. DURING THE BETA PERIOD, WHEN THE SERVICE IS FREE, THIS AMOUNT IS ZERO.

9. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

10. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in the Service, applicable law, or our business practices. We will notify you of material changes by email (to the address associated with your account) or by posting a prominent notice on the site at least 14 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should discontinue use of the Service and may request deletion of your account by emailing rptgeek@gmail.com.
